(The following General Terms and Conditions contain also legal information about your rights according to the German regulations about contracts in distance trade and in e-commerce)
These General Terms and conditions are effective for all orders placed with
the online shop of
hoerjuwel Manke & Toepel GbR, Wallstr. 89, 10179 Berlin; Germany
(in the following „hoerjuwel“).
Hoerjuwel is a checked online shop and has committed itself to meeting the requirements of the Trusted Shops Regulation (see www.trustedshops.com).

2. Offer and Conclusion of a Contract
2.1 Our advertised prices are gross prices inclusive of all applicable value-added
tax. VAT is indicated separately on the invoice if applicable. Non-EU adressees
will be delivered tax-free.
2.2 The presentation of product details at the shop is an invitation to
order, but not a legally binding offer. Errors excepted. By clicking on
the "Confirm Order" button, you effect a binding order of the
merchandise contained in your shopping cart. Immediately after placing your
order, you will receive confirmation that your order has been received.
The sales contract comes only into force upon our order confirmation (send within 5
working days) or delivery of the merchandise.
2.3 You may conclude the sales contract in German or English. We save the
text of the sales contract and send it to you by mail. You may see previous
orders in your protected customer account after log-in.
3. Prices
3.1 Contacted prices are ex distribution warehouse of hoerjuwel's choosing and
do not include any additional services. Delivery is effected at the individual
shipping charges indicated in each specific case.
3.2 We offer free shipping to addresses within Germany. Additional charges for
special services charged by the German Post Office or courier service (e.g.
COD) are not included. Shipping costs to addresses abroad are clearly shown
at the product detail pages, in the shopping cart and during checkout.
4. Delivery
4.1 Hoerjuwel is entitled to effect partial deliveries provided this is economically
viable for the contracting party.The charges for delivered merchandise also
become due in the case of partial delivery upon shipment and receipt of the
invoice.
4.2 If the ordered product is not available because of non-delivery to hoerjuwel
through no fault of us, we are entitled to withdraw from the contract. In this
case we will inform you immediately and suggest the delivery of a comparable
product if applicable. If there is no comparable product available or you don't
want to get such a product, we will refund any payments without delay.
5. Return Guarantee and Instruction
5.1 Consumers may return merchandise without giving any reason within 14 days
of receipt of said merchandise.
5.2 Returns of audio or video recordings or software are excluded if their
packaging seal has been broken.

Right to Return
You may return merchandise without giving any reason within 14 days
of receipt of said merchandise unless you have been acting in the capacity of
a commercial or independent professional.
This time limit starts after receipt of this instruction, but not before the
arrival of the goods at the recipients' door (for repeated delivery of similar
goods not before the arrival of the first partial delivery)
and also not before the fulfilment of our information obligations acc. to Article 246 §
2 in connection with § 1 par. 1 and 2 EGBGB
as well as our obligations acc. to § 312g par. 1 sent. 1 BGB in connection
with Article 246 § 3 EGBGB. Only domestic return shipment (i.e. from inside Germany)
is at our cost and risk.
To ensure deadline compliance, the timely return of the merchandise will suffice when addressed to:

Return Follow-Up
In the event of a valid return, reciprocal services are suspended and any beneficial use obtained shall be surrendered (e.g. compensation for use). Deterioration in merchandise value may be subject to compensation. The latter shall not apply when the merchandise deterioration is due exclusively to the inspection of same - as for example would have been possible in a retail shop. You can otherwise eliminate the obligation to indemnify damages in value by not using the merchandise in the manner of an owner and refraining from all actions which would diminish its value. Refunds must be made within 30 days. The time limit starts for you with the shipment of the goods to hoerjuwel, for us with its arrival.

6. Retention of Title
The delivered merchandise remains the property of hoerjuwel until all receivables
from the current business relation between hoerjuwel and the Customer have been
paid in full.
7. Maturity and Payment
7.1 Hoerjuwel only accepts the forms of payment indicated to the customer at
the time each order is placed. The purchase price as well as any applicable
order fees and/or shipping charges incurred become due at contract conclusion.
7.2 If payment is made by debit entry you have to bear the rebooking cost incurred
if there are no funds at the account or mistakes in given data for the account.
7.3 Should the customer enter into arrears, hoerjuwel is entitled to charge
interest on arrears at 5% p.a. over the respectively recognised base rate of
the European Central Bank. Should hoerjuwel incur demonstrably higher damages
due to delay, hoerjuwel shall be entitled to claim said damages.
